Terms of Service

These Terms of Service ("Terms") govern your use of www.ganpatrai.in and the GanpatrAI HR product. By using the website or signing up for a pilot, you agree to these Terms.

1. Parties

"GanpatrAI", "we" or "us" means GanpatrAI Tech Sol, India. "You" or "Customer" means the hospital, medical college, healthcare institution or individual using the website or product.

2. Eligibility

You must be at least 18 years old and authorised to enter into contracts on behalf of your institution to book a demo, sign a pilot agreement or purchase a subscription.

3. Use of the website

You agree not to: (a) attempt to access non-public areas of the site or our infrastructure; (b) probe, scan or test the vulnerability of our systems; (c) interfere with service to any user; (d) scrape or copy content other than for fair, personal evaluation; (e) misrepresent yourself or your institution.

4. Demos and pilots

GanpatrAI offers a free 30-day pilot to qualified hospitals and medical colleges. The scope, departments covered, success criteria and data-handling terms of each pilot are recorded in a written Pilot Agreement signed by both parties. These Terms apply in addition to that Pilot Agreement; where they conflict, the Pilot Agreement controls.

5. Licence to the product

Once you subscribe, GanpatrAI grants you a non-exclusive, non-transferable, revocable licence to install and use the software on your hospital network for the institution's own internal HR operations, for the duration and headcount stated in your Order Form. You may not sublicense, resell, white-label or reverse-engineer the product.

6. Customer data ownership

You retain ownership of all employee records, biometric files, rosters, payroll inputs, certificates and approval logs ("Customer Data") that you put into the system. GanpatrAI receives only the limited rights necessary to operate the product. On termination, we will provide a full export of Customer Data in a machine-readable format and securely destroy any residual copies we hold.

7. Acceptable use inside the product

• The system is designed for legitimate HR, attendance, rostering and training workflows. It must not be used to surveil employees outside working hours, to retaliate against whistle-blowers, or in any way that violates Indian labour law.
• Anti-cheat features in the Induction module (webcam capture, IP recording) must be disclosed to employees in the institution's induction notice and HR policy.

8. Fees and payment

Fees are stated in your Order Form. All amounts are in Indian Rupees and exclusive of applicable GST. Invoices are payable within 30 days. Late payment may attract interest at 1.5% per month. Pilots are free for the agreed pilot period.

9. Service availability and support

Because GanpatrAI is an on-premise product, day-to-day availability depends on your hospital's own server and network. We commit to remote support during Indian business hours (Mon–Sat, 9:30–18:30 IST), email support 24/7, and a target response time of 4 working hours for Severity-1 incidents.

10. Confidentiality

Both parties will protect each other's confidential information (including non-public technical details, pricing, employee data and patient counts) with at least the same care they apply to their own confidential information, and not less than reasonable care.

11. Intellectual property

The software, source code, documentation, brand, dashboards, prompts and AI models are and remain the intellectual property of GanpatrAI Tech Sol. Feedback you provide may be incorporated into the product without obligation.

12. Warranty and disclaimer

We warrant that the software will materially conform to its documentation during your subscription. Except for that warranty, the product and website are provided "as is" — see the Disclaimer for the full statement.

13. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, consequential or punitive damages. Each party's aggregate liability under these Terms is capped at the fees paid by the Customer in the 12 months preceding the claim.

14. Termination

Either party may terminate for material breach uncured after 30 days' written notice. On termination we will assist with data export and uninstallation. Sections that by their nature survive (Confidentiality, IP, Limitation of Liability, Governing Law) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at the city of GanpatrAI's registered office, save that either party may seek interim injunctive relief in any court of competent jurisdiction.
